Terms of Use (CGU)

1. Object
These General Terms of Use ("CGU") define the access and use conditions of the SMS Node SaaS platform (hereinafter "the Platform").
SMS Node provides software infrastructure allowing users to connect their own Android devices and SIM cards to manage their professional SMS communications via a web interface and automation tools.
2. Nature of Service
SMS Node exclusively provides:
- A SaaS platform;
- An SMS management interface;
- API tools;
- Automation tools;
- Connected Android device management features.
SMS Node is NOT: a telecom operator, a number provider, or responsible for content.
3. Access to the Platform
Access requires account creation. Users are responsible for the confidentiality of credentials and all activities performed from their account.
4. User Responsibility
The user is solely responsible for:
- SMS content;
- Recipients;
- Consents;
- Compliance with GDPR and Anti-Spam laws.
5. Prohibited Uses
Spam, phishing, fraud, harassment, illegal content, and malware are strictly prohibited.
6. Pricing and Payment
Subscription prices are displayed on the Platform. Fees are payable in advance. SMS Node reserves the right to modify pricing with notice to existing subscribers. No refunds are provided for early termination by the user.
7. Right of Withdrawal
As the service is dedicated to professional use (B2B) and involves immediate access to digital software, the standard consumer right of withdrawal does not apply once the service has started.
8. Suspension and Termination
SMS Node may suspend or delete an account without notice in case of violation of these CGU or illegal activity.
9. Limitation of Liability
SMS Node acts as a technical provider. We do not control content or mobile networks.
Total liability is limited to the amounts paid by the user over the last three (3) months.
10. Indemnification
The user agrees to indemnify SMS Node for any claims resulting from illegal use or violation of laws.
11. Personal Data
Users own their contacts and data. SMS Node acts as a technical subprocessor under GDPR.
12. Service Availability
No guarantee of permanent availability is provided. Maintenance or network issues may occur.
13. Intellectual Property
The Platform and its components remain the exclusive property of SMS Node.
14. Changes to CGU
SMS Node may modify these CGU at any time.
